Attorney Bruce E. Newman obtains important District Court ruling against DirecTV
Bruce Newman along with New York counsel filed a class action lawsuit on behalf of Jean Flynn, and other similarly situated owners of residential multiple dwelling units who lease to tenants and have DirecTV dishes and equipment installed on their premises without their consent. Oftentimes landlords are left with satellite dishes on their roofs or on the sides of their building when they never authorized that this equipment be affixed to the exterior of their buildings. In addition to the poor aesthetics, these owners have to incur costs for removal and repair of this equipment. Newman alleged, among other things, that this practice violated the Connecticut Unfair Trade Practices Act or “CUTPA.” DirecTV moved to dismiss these class allegations and other claims. In a significant ruling of August 23, 2016 the US District Court for the District of Connecticut agreed with Newman and his clients and denied the Motion to Dismiss the CUTPA class action allegations.
