A transgender father of two sons was facing divorce. The couple disagreed about whether the husband's circumstances had been understood by the wife before they married and had children. As it became clear the marriage was ending in the face of this issue, the husband wanted more and more to live openly as a woman. The children were noticing changes and their mother felt they needed to be sheltered from what she was sure would upset them. The father didn't want to lose his relationship with his children for whom he had always been an active and caring parent. Attorney Haakonsen represented the father. After lengthy and careful negotiations and with the help of a guardian ad litem for the children and mental health professionals, the parties were able to agree to joint legal custody and a reasonable schedule of parenting time with the father with the hope that he now she would have increased time as the children became more accustomed to the changes in their father's life.
